1. Introduction
This End User License Agreement ("Agreement") governs your use of GHOST ("App"), a mobile application operated by GhostHub FZE ("Company", "we", "us"). By using the App, you agree to be bound by this Agreement.
2. Device Simulation Features
The App includes simulated paranormal detection capabilities. Users acknowledge these are FOR ENTERTAINMENT PURPOSES ONLY. These features function as novelty items, do not genuinely detect paranormal activity, generate randomized results, make no scientific claims, and should not be relied upon for any professional or safety-related purpose.
3. User Content & Intellectual Property
The App allows you to submit content including ghost stories, blog posts, haunted location tips, reviews, images, and chat messages ("User Content"). By submitting User Content, you agree to the following:
- Ownership & Rights:You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any User Content you submit, including all images, text, and media. You must not upload content that infringes on any third party's intellectual property rights, including copyrights, trademarks, or rights of publicity.
- License Grant: By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely in connection with operating and providing the App. You retain ownership of your User Content.
- Indemnification:You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your User Content, including any claim that your User Content infringes or violates any third party's intellectual property or other rights.
- No Liability for User Content: The Company acts as a platform and host for User Content. We do not endorse, verify, or assume responsibility for any User Content posted by users. The Company is not liable for any intellectual property infringement caused by User Content.
4. Copyright Infringement & Takedown
If you believe that content on the App infringes your copyright or other intellectual property rights, please contact us at [email protected] with the following information:
- A description of the copyrighted work you claim has been infringed.
- A description of where the allegedly infringing material is located in the App.
- Your contact information (name, email, and phone number).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We will review all valid notices and take appropriate action, which may include removing the infringing content and suspending or terminating the accounts of repeat infringers.
5. Content Submissions
Story Submissions: Stories and blog posts may be subject to review. The Company reserves the right to reject, edit, or remove any submission. Plagiarism or submission of copyrighted content without authorization will result in content removal and may result in account termination.
Location Submissions: Haunted location tips are subject to review. Only publicly accessible locations qualify unless private property owners provide documented permission. Users must provide accurate information and include safety warnings where applicable.
6. Prohibited Content
Users must not submit content involving:
- Illegal activities
- Hate speech or discrimination
- Graphic violence or exploitation of real deaths
- Disclosure of private or personal information of others
- Sexually explicit material
- Self-harm or suicide promotion
- Fraudulent or misleading claims
- Intellectual property infringement
- Harassment, bullying, or threats
- Malware, spam, or other harmful content
7. Chat and Group Features
Group Types: Public (visible to all), Private (approval required), and Secret (invitation-only).
Policies: Group creators are responsible for moderating their groups. The Company monitors activities, may terminate groups promoting harmful content, and reviews reported messages for violations.
8. Account Termination
The Company may suspend or terminate your account for violations of this Agreement, prohibited content, harassment, filing false reports, promoting dangerous activities, impersonation, or creating multiple accounts.
9. Content Moderation
The Company reserves the right to review, reject, edit, or remove any content at its sole discretion. We may monitor communications, investigate reported violations, and cooperate with law enforcement when required.
10. Disclaimer of Warranties
THE APP AND ALL FEATURES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. The Company makes no representations regarding the accuracy, reliability, or completeness of any content, and expressly disclaims any claims of paranormal detection or supernatural capability.
11. Privacy and Data Collection
Data collection and processing is governed by our Privacy Policy. Chat messages, location data, and group activity are retained for moderation and safety purposes.
12. Age Restrictions
Users must be at least 13 years old to use the App. Users under 18 must have parental or guardian consent. Providing false age information may result in account termination.
13. Updates and Modifications
The Company may modify this Agreement, update or remove features, adjust policies, and modify or discontinue services at any time. Continued use of the App after changes constitutes acceptance of the updated terms.
